ILLINOIS had its own e-waste management law signed on September 17, 2008. The legislation mandates that all manufacturers set up and pay for the collection, transportation, and recycling of all covered electronic devices that they sell within the state. The state has also provided an innovative recycling benchmarking system that requires manufacturing companies to recycle 60% of a goal set by the Illinois government.
The expectancy rate that the manufacturers need to meet is the minimum 60% of the goal in a three-year period. After that span of time, they are required to increase the rate by 15% in the 4th year. Failure to comply will subject the manufacturers to reprimand and grave penalties.
This Illinois Electronic Waste Recycling Act (Public Act 97-0287: Electronics Products Recycling & Reuse Act) enforces a statewide system for recycling and/or reusing discarded electronic items listed below from residences, through the requirement of electronic manufacturers to participate in the management and control of e-wastes:
- Facsimile Machines
- Digital Video Disc Recorders
- Satellite Receivers
- Small Scale Servers
- Electronic Mice
- Cable Receivers
- Video Game Consoles
- Portable Digital Music Players
- Electronic Keyboards
- Computers (laptop, notebook, tablet, desktop, netbook)
The environmental protection agency of the state firmly enforces the recycling rules and regulations on all manufacturers operating in Illinois. In fact, the businesses which will not comply or try to violate the provisions on the bill shall be liable for a civil penalty not to exceed $10,000 for the violation and an additional fine not to exceed $10,000 for each day the violation is continued.
To advance the platforms further, Section 95 of the House Bill puts into effect a total ban of e-wastes dumped in the local landfills on January 1, 2012.
